This website is operated by Charlie Whinney Studio ("we," "our," "us"), a UK-based studio creating and selling sculptures and related artworks.
2. Scope of These Terms
These Terms and Conditions govern your use of our website and your purchase of products via www.askatree.net, including purchases made in connection with our physical exhibition event.
By using our website or purchasing from us, you agree to these Terms.
3. Exhibition Event Sales (May 2026)
During May 2026, our sculptures will be exhibited at the Park Hyatt London River Thames.
Customers visiting the exhibition may:
Scan QR codes displayed next to artworks
Access corresponding product pages on our website
Complete purchases online via their own device
3.1 Proof of Purchase
Customers must present a valid proof of purchase (order confirmation screen or email) to collect any item onsite.
We reserve the right to refuse collection where valid proof is not provided.
3.2 Availability
All artworks are subject to availability. Many items may be unique, and once sold, they will no longer be available.
4. Product Categories and Fulfilment
4.1 Smaller Items (Onsite Collection)
Products marked as "smaller items":
May be collected on the day of purchase at the exhibition venue
Must be collected during the exhibition period (May 2026)
Will be released upon proof of purchase
May be packaged with assistance from hotel staff if requested
Responsibility for the artwork passes to the customer immediately upon receipt of the item.
4.2 Larger Items (Delivery)
Products marked as "larger items":
Will not be available for immediate collection
Will be shipped to the address provided at checkout
Will be dispatched during the first two weeks of June 2026
Delivery timeframes are estimates and may be affected by external factors.
Responsibility for the artwork passes to the customer once the item has been delivered and received safely.
5. Pricing and Payment
All prices are listed in GBP (£) and include VAT where applicable
Payment must be made in full at the time of purchase
We reserve the right to change prices at any time before purchase
6. Consumer Rights (UK Compliance)
6.1 Right to Cancel (Distance Selling)
Under the Consumer Contracts Regulations 2013, you may have the right to cancel certain purchases within 14 days.
However, this right may not apply to:
Custom or commissioned artworks
Items that are clearly personalised
Items collected in person at the exhibition
6.2 Faulty or Misdescribed Goods
Under the Consumer Rights Act 2015, you are entitled to:
Goods that are as described
Goods of satisfactory quality
Remedies including repair, replacement, or refund where applicable
7. Returns and Refunds
Returns must be requested within 14 days of delivery (for shipped items)
Items must be returned in original condition and packaging
You are responsible for return shipping costs unless the item is faulty
Due to the nature of artworks, we recommend careful inspection upon receipt.
8. Intellectual Property and Artist's Resale Rights
All images, artwork, designs, and content are the property of Charlie Whinney Studio and are protected by copyright laws.
Copyright in all works remains with Charlie Whinney Studio at all times, even after the physical artwork has been sold.
Ownership of a physical artwork does not transfer any intellectual property rights. Buyers may not reproduce, distribute, publish, or create derivative works based on the artwork without prior written permission.
8.1 Resale of Artwork
The resale of purchased artworks is permitted. However:
Buyers must not misrepresent the artwork or its origin
Buyers must not reproduce the work for commercial purposes without permission
8.2 Artist's Resale Right (ARR)
In accordance with the Artist's Resale Right Regulations 2006, Charlie Whinney Studio (and/or the artist) may be entitled to receive a royalty on certain resales of original works of art.
This applies where:
The resale involves an art market professional (such as a gallery, dealer, or auction house), and
The resale price meets the legal threshold
Where applicable, the responsibility for paying any resale royalty lies with the relevant art market professional handling the resale, as required by law.
9. Certificate of Authenticity
Where applicable, each artwork may be accompanied by a Certificate of Authenticity issued by Charlie Whinney Studio.
The Certificate of Authenticity:
Confirms the origin and authenticity of the artwork
May include details such as title, materials, dimensions, and date
We recommend that the Certificate of Authenticity is retained securely, as it may be required for insurance, valuation, or resale purposes.
Charlie Whinney Studio reserves the right not to issue replacement certificates where originals are lost, except at its sole discretion.
10. Condition and Natural Variation
Due to the nature of handcrafted sculptures and natural materials:
Each artwork is unique and may include natural variations in colour, grain, texture, or form
Minor imperfections, irregularities, or organic characteristics are inherent to the work and are not considered defects
By purchasing an artwork, you acknowledge and accept these natural variations as part of the artistic process.
Customers are encouraged to review all available images and descriptions carefully before purchase.
11. Care and Responsibility for Artwork
Once responsibility for the artwork has passed to the customer (as outlined in Section 4):
The customer is responsible for the proper handling, installation, and care of the artwork
Charlie Whinney Studio is not responsible for damage caused by improper handling, environmental conditions, or installation
We recommend that:
Artworks are handled with care and, where appropriate, installed by professionals
Suitable environmental conditions are maintained (e.g. avoiding excessive humidity, heat, or direct sunlight)
Guidance on care may be provided upon request, but remains advisory only.

We comply with the UK GDPR and the Data Protection Act 2018.

All responsibility for the sale, condition, and fulfilment of artworks rests solely with Charlie Whinney Studio and, where applicable, the customer after transfer of responsibility.
15. Changes to These Terms
We may update these Terms at any time. Changes will be posted on this page with an updated effective date.
16. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes will be subject to the jurisdiction of the English courts.
